Navigating Auto Insurance After a Car Accident
It is getting harder for victims of car accidents to access treatments they need in order to recover from injuries sustained in a motor vehicle accident.
Hello, my name is Lisa Morell Kelly. I have been a lawyer for 24 years and practicing personal injury with Morell Kelly Lawyers since 2004. Over the last 20 years it has been harder for victims of car accidents to access treatment they need to get better and to be compensated for injuries they have suffered in car accidents for some of the following reasons:
a) The legislation governing entitlements to benefits is very complicated, the forms are difficult to understand and complete
b) Licencing and billing requirements created for treatment providers effectively limit your choice as to who provides your treatment by providing a very limited roster of treatment providers
c) Access to treatment is limited in many cases by the Minor Injury Guideline and treatment is constantly interrupted pending insurer approval and insurer exams
d) Every treatment plan can be subjected to an insurer exam which means that you will have to go all over Ontario to see doctors of their choice and this will be time consuming. You can expect an insurer exam to use up a half day of your time
e) Lack of consumer education - almost no one knows what the process will be for them to get treatment until after they are hurt in an accident….then I liken it to when Alice falls into the rabbit hole....
What You Should Know:
It is important to consider purchasing all OPTIONAL coverages available to you. These coverages are available to you at minimal cost and will greatly enhance your access to coverage for medical rehabilitation benefits and income replacement benefits if you are hurt in an accident. Talk to your broker today about these optional coverages.
You should also ensure that you have adequate liability coverage to protect your assets if you are determined to be at fault in an accident. In most cases you can upgrade your liability coverage from 1 million to 2 million at minimal cost. This is worth doing as it is not difficult for the 1 million in coverage to be exceeded if there are medically complicated injuries or more than one person injured in the accident.
If you have been injured in a car accident you will benefit greatly if you have the advice and representation of legal counsel to help you negotiate your way through this maze and to access the treatment you need as early as possible to maximize your chances of making a good recovery from your injuries.
